Welcome to ClawedMarket ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the ClawedMarket website, API, tools, and services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
ClawedMarket is operated from Switzerland by Giovandomenico Costantino as a sole proprietorship. Operator details are set out on the Legal & Compliance page. If you do not agree to these Terms, do not use the Services.
You must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.
The Services are not available to persons or entities located in jurisdictions subject to comprehensive sanctions administered by OFAC, SECO, the European Union, the United Kingdom, or the United Nations, or in any jurisdiction where cryptocurrency transactions or the activities described in these Terms are prohibited by law. By using the Services you represent that you are not a Sanctioned Person and are not located in a Sanctioned Jurisdiction.
Merchants must register with a valid email address and store name. Authentication is handled via magic link (passwordless email login).
Agent Operators receive API keys upon registration. You are responsible for keeping your API keys secure. Any activity using your API key is your responsibility. Notify us immediately if you suspect unauthorized use.
The ClawedMarket API is free to use for search, product lookup, and comparison queries. We charge a 1.5% transaction fee on the total amount of each completed purchase (subtotal + shipping). This fee is calculated transparently and included in the checkout response.
Merchants receive the full product price minus the platform fee. No hidden charges, monthly minimums, or subscription fees apply.
All transactions on ClawedMarket are settled in cryptocurrency, primarily USDC on the Base network. By using the payment features, you acknowledge and agree that:
ClawedMarket provides spending controls for AI agents, including per-transaction limits, daily limits, lifetime limits, merchant whitelists, and delegation expiry. These controls are advisory tools provided for the Agent Operator's convenience.
The Agent Operator is solely responsible for configuring appropriate spending limits and monitoring their Agent's activity. ClawedMarket is not liable for purchases made by an Agent acting within its configured limits, even if those purchases were unintended by the Operator.
Agent Operators must ensure their Agents comply with all applicable laws and do not use the Platform for prohibited activities.

A complete prohibited-use list is set out on the Legal & Compliance page. We may, at our sole discretion, suspend any account, delist any product, and reverse or freeze any pending transaction we reasonably believe is connected with prohibited activity.
ClawedMarket does not accept fiat payments at any point and does not perform fiat-to-crypto conversion. Users fund their agent wallet by sending USDC on the Base network from a third-party source of their choice (regulated exchange, self-custody wallet, or peer). Identity verification, sanctions screening, and transaction monitoring on the fiat side are performed by that third-party source under its own regulatory framework.
ClawedMarket may suspend, freeze, or report any transaction or account that we reasonably believe is connected with money laundering, terrorism financing, sanctions evasion, or other unlawful activity, and will cooperate with the Money Laundering Reporting Office Switzerland (MROS) and other competent authorities where required by law. We may screen wallet addresses against publicly available sanctions and high-risk address lists.
Orders follow the lifecycle: PENDING → PAID → PROCESSING → SHIPPED → DELIVERED → COMPLETED. Unpaid orders expire after 15 minutes.
In case of disputes between Buyers and Merchants, ClawedMarket may, at its discretion, mediate the dispute. However, ClawedMarket is a marketplace facilitator and does not guarantee the quality, safety, or legality of listed products. Merchants are responsible for resolving buyer complaints.
The ClawedMarket name, logo, API design, and website content are the intellectual property of ClawedMarket. Merchants retain ownership of their product content. By listing products, Merchants grant ClawedMarket a non-exclusive license to display and distribute product information through the API and website.
To the maximum extent permitted by applicable law, ClawedMarket shall not be liable for:
Our total cumulative liability shall not exceed the platform fees collected from your transactions in the 12 months preceding the claim.
You agree to indemnify and hold harmless ClawedMarket, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, Merchants, or the Platform. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and governing law) shall survive.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use of the Services after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Switzerland. Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Zurich, Switzerland.
